Terms of Service

These terms govern your use of Cargo44, a shipment management platform operated by Cargo44 (“we”, “us”). By creating an account you agree to these terms.
1. What we provide
Cargo44 is a software tool for managing freight shipments, customer communications, tracking, proof of delivery, and billing. We are a software provider only. We do not:
- Transport, ship, or handle any goods.
- Act as a freight forwarder, carrier, customs broker, or declarant of record.
- Verify, validate, or take responsibility for the accuracy of any data entered into the platform — including shipment details, cargo descriptions, declared values, or customs information.
- Guarantee the delivery, condition, or safe passage of any shipment managed through the platform.
Documents generated by the platform (including shipment receipts, customs declaration forms, shipping labels, and invoices) are produced using data entered by you or your team. These documents are tools for your business operations — they do not represent declarations, certifications, or warranties by Cargo44. You are solely responsible for reviewing all generated documents for accuracy before use.
2. Your account
You are responsible for keeping your login credentials secure. Each organisation account is managed by its admin(s). You must not share agent or driver invite links with unauthorised people.
3. Your data
You own the data you enter into Cargo44 — shipment records, customer information, media, and financial records. We do not claim any rights over your content. See our Privacy Policy for how we store and process it.
You are responsible for ensuring you have the right to store and process your customers' personal data (names, phone numbers, etc.) and for complying with applicable data protection laws.
4. Acceptable use
You agree not to:
- Use the platform to send spam or unsolicited messages.
- Upload illegal, harmful, or infringing content.
- Attempt to access other organisations' data.
- Reverse-engineer, scrape, or resell the platform.
We reserve the right to suspend accounts that violate these terms.
5. WhatsApp messaging
WhatsApp notifications are sent through Twilio on your behalf. You are responsible for the content of messages sent through your account and for complying with WhatsApp's business messaging policies. Message delivery depends on Twilio and WhatsApp availability, which we do not control.
6. Billing and cancellation
Paid plans are billed monthly via Stripe. You can upgrade immediately or schedule a downgrade for the end of your billing period. Cancellations take effect at the end of the current period — no partial refunds are issued. Overage charges (extra shipments beyond your plan allowance) are billed at the end of each billing cycle.
7. Service availability
We aim to keep Cargo44 available and reliable, but we do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or experience outages. We are not liable for losses caused by downtime.
8. Your responsibilities
As the operator of your freight forwarding business, you are solely responsible for:
- The accuracy of all data entered into the platform by you, your staff, agents, or drivers — including customer details, cargo descriptions, declared values, and customs information.
- Compliance with all applicable laws and regulations governing the shipment of goods, including customs, import/export controls, prohibited items, and sanctions.
- The relationship with your customers, including disputes about shipments, pricing, delivery, or damage.
- Ensuring any agents or drivers you invite to the platform act within their authority and in accordance with applicable laws.
Cargo44 does not review, audit, or validate any information you enter. If a customs authority, law enforcement agency, or other party raises an issue with a shipment managed through the platform, that is a matter between you, your customer, and the relevant authority — not Cargo44.
9. End-user access
Certain features of Cargo44 allow your customers (end users) to interact with the platform directly — including submitting booking requests, viewing tracking pages, and making payments. These end users are your customers, not ours. You are responsible for your relationship with them, including any disputes about shipments, charges, or services. Cargo44 is not a party to any transaction between you and your customers.
Payments collected from your customers via the platform are processed by Stripe on your behalf. Cargo44 facilitates the payment flow but does not hold, manage, or guarantee any funds. Refund and payment disputes are between you and your customer.
10. Indemnification
You agree to indemnify and hold harmless Cargo44, its officers, and employees from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (a) your use of the platform; (b) the accuracy or legality of data you enter; (c) disputes with your customers or any third party; (d) any breach of these terms; or (e) any customs, regulatory, or legal action related to shipments managed through the platform.
11. Limitation of liability
Cargo44 is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including but not limited to: lost, seized, damaged, or delayed shipments; incorrect customs declarations or documents; missed deliveries; regulatory penalties; or any business losses. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
12. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via the email on your account. Continued use of the platform after changes take effect constitutes acceptance.
13. Governing law
These terms are governed by the laws of England and Wales.
